In certain circumstances, Americans with Disabilities Act (ADA) plaintiffs may experience difficulty if they have applied for Social Security benefits, long-term disability benefits, or made other formal statements about their level of disability. In some ADA employment cases, courts have ruled that a person could not claim that they were a “qualified person with a disability” if they received Social Security disability benefits.
